Kanun Tanah Negara 1965: A Brief Overview




The Kanun Tanah Negara 1965 (National Land Code 1965) is a Malaysian law that regulates land administration and land tenure in the country. It was enacted in 1965 as Act of Parliament No. 56 of 1965 and came into force on 1 January 1966. It replaced the previous land laws of the Malay states, Penang and Malacca, which were based on the Torrens system of land registration. The Kanun Tanah Negara 1965 aims to provide a uniform and comprehensive system of land law for the whole of Malaysia, except for Sabah and Sarawak, which have their own land codes.

The Kanun Tanah Negara 1965 also provides for the establishment of a National Land Council, a Computerized Land Registration System, an Electronic Land Administration System, and a Pengurusan Danaharta Nasional Berhad Act 1998 to facilitate the implementation of the code.


The Kanun Tanah Negara 1965 has been amended several times since its enactment to keep up with the changing needs and circumstances of the country. Some of the major amendments include Act A328 (1976), which introduced strata titles for subdivided buildings; Act A590 (1984), which revised the provisions on Malay reservation land; Act A654 (1988), which revised the provisions on leases; Act A828 (1990), which revised the provisions on charges; Act A1026 (1994), which revised the provisions on easements; Act A1102 (1996), which revised the provisions on revocation and forfeiture; Act A1137 (1998), which revised the provisions on surrender and re-alienation; Act A1159 (2000), which revised the provisions on partition and amalgamation; Act A1284 (2006), which revised the provisions on subdivision and consolidation; and Act A1443 (2010), which revised the provisions on strata titles.
